The election campaign manager for Newcastle's new Lord Mayor is already claiming to be his Chief of Staff, despite applications for the job closing next week.
The United Services Union says it has several concerns about the Lord Mayor, Jeff McCloy, including comments he made that work needs to be tendered to the private sector to trim jobs.
The dispute was today heard in the Industrial Relations Commission.
The Commission was told Councillor McCloy has no part to play in the Enterprise Bargaining Agreements of Council staff.
Representing the USU, Noel Martin said the Local Government Act is clear - the agreement it is to be negotiated by staff, their Unions, and Council's General Manager - not the Lord Mayor.
The Union also has concerns about a recent job advertisement regarding a policy advisor or Chief of Staff to the Lord Mayor.
The applications close next Wednesday.
Mr Martin tendered a document which showed Councillor McCloy's campaign manager, Josh Hodges, already claiming to be the "Chief of Staff to the Lord Mayor" on his personal Facebook page.
Mr Martin says Council is also breaching its obligations because the Union and a Consultative Committee has not been informed about the new position.
Newcastle Council and the Union have been directed to discuss the issues and report back to the IRC at the end of next week.
